When Minnesota residents suffer an injury on the job, they can sometimes feel like their options are limited. While recovering from their injury, how will they pay their bills? For most employees in Minnesota and other states, the answer is a claim for workers’ compensation. Unfortunately, railroad workers don’t have this option.
Instead, a railroad worker who is injured on the job in Minnesota, whether it is because of a train accident or some other type of railroad accident, must pursue a claim under the Federal Employers’ Liability Act, also known as “FELA.” However, while an injured railroad worker might need to go a different route than most others to recover compensation after an accident, there are benefits for pursuing a claim under FELA as opposed to workers’ compensation.
For instance, our readers may not know that under workers’ compensation there is usually a cap of benefits that can be awarded. That isn’t the case with FELA. And, besides pursuing a claim for loss of income due to the job-related injury, a Minnesota railroad worker can also seek compensation for other issues, such as pain and suffering.
At Yaeger & Weiner Law, we understand that injured workers may have many different questions about their options after an on-the-job accident. We don’t want them to think that their options are limited. We do our best to attempt to make sure that our clients get the compensation they deserve.
